Duterte ICC Case: Ex-SC Justice Flags ‘Abuse of Process’ in March 2025 Arrest

Retired Supreme Court Justice Adolfo Azcuna told senators that former President Duterte's arrest and surrender to the ICC may have bypassed a critical legal step—court presentation under Philippine law.

Azcuna warned the missing procedure could be seen as “abuse of process” by the ICC and called on the Supreme Court to determine its legality.

He raised concerns of “extrajudicial rendition,” urging a review ahead of the ICC’s pretrial in September 2025.
