Lawsuit over the former Happy Hollow elementary school to be heard in court

A judge in Lake County ruled against the state's challenge to dismiss the case.

Superintendent Rocky Killion says the support from other schools and taxpayers helped in the ruling.

Corporation says it picked up a win last week.

As we previously reported, the school corporation is fighting a state law that requires public school corporations to lease unused school buildings to charter schools for one dollar.

This could affect the former happy hollow elementary school.

Last week a judge in lake county ruled against the state's challenge to dismiss the case.

Superintendent rocky killion says the support from other schools and tax payers helped in the ruling.

What helped i thought in the hearing is we had over 1-thousand signatures from local tax payers supporting west lafayette moving forward to protect this asset.

Killion believe this case will end up in front of the indiana supreme court.

He says the evidentiary hearings will likely start in the next few months.
