Obamacare Survives Latest Supreme Court Challenge

Obamacare , Survives Latest Supreme Court Challenge.

Obamacare , Survives Latest Supreme Court Challenge.

On June 17, the Affordable Care Act was kept alive by a 7-2 vote.

The suit was brought on by 18 states and two individuals.

.

In 2012, a central provision of the law was upheld, requiring Americans to obtain health insurance or pay a penalty.

At the time, Chief Justice John G.

Roberts Jr. said this was authorized by Congress' power to levy taxes.

In the new case, the plaintiffs argued that once Congress eliminated the penalty in 2017 because it could no longer be justified as a tax, the mandate became unconstitutional.

As a result, the plaintiffs said the rest of the law must also be dissolved.

.

But the court ruled that they were not in a position to bring the claim because they could not demonstrate any past or future harm.

Justice Samuel Alito and Justice Neil Gorsuch had dissenting opinions about the entirety of Obamacare remaining intact.

.

So a tax that does not tax is allowed to stand and support one of the biggest Government programs in our Nationโ€™s history.

Fans of judicial inventiveness will applaud once again, Justice Samuel Alito, via Fox News
