To stophe construction of the new downtown hospital was dismissed in state supreme court.

News channel 2's caitlin irla tells us about this decision from the site of the future hospital.

The lawsuit was filed in albany county by the landmarks society of greater utica and the #nohospitaldownto wn group in may of 2019.

The lawsuit calls into question the state environmental quality review, or the seqr, of the property, claiming the proper procedureswe groups were not provided an opportunity to comment on the review.

This past april, the case was moved to state supreme court in oneida county, and oral arguments were heard by judge bernadette rono- cla.

The document reads -- "this court opines that, petitioners failure to seek a preliminary injunction or a stay to either prevent construction on the project from commencing or continuing, once the planning board issued final site plan approval was fatal to their case."
