Murder Investigation After Inmate Killed

New information -- the attorney for a capital murder suspect is asking for his client to be released from the madison county jail on electronic monitoring after his brother - terran burt - was murdered in the jail on friday.

Today- the sheriff's office announced - michael wheeler - is charged with burt's murder.

Burt died at huntsville hospital friday night - following a fight between the two that morning.

Dan, najahe- the madison county sheriff's office is not ready to release a motive for the fight that happened here friday morning that left one inmate dead and another charged with murder.

Court documents filed tuesday by a huntsville attorney - claim that gang members murdered terran burt in the jail-- the attorney for hasaan erskine, stated in court documents filed on tuesday that they believe gang members murdered his brother and codefendant, terran burt.

In the motion, the attorney said, "it is believed that the intent is to also get this defendant."

He also stated that erskine's mother is battling cancer and just lost her son, and that they are concerned for her well-being.

Sheriff kevin turner said wednesday morning that the investigation has not found evidence burt's murder is gang-related.

Sheriff turner said erskine was put in an isolation cell at the jail and he met with him tuesday night.

The sheriff said he has also spoken to both men's mother, and given his condolences for the family's loss as well as assured her they are keeping her other son safe.

Turner said he was set to meet with the judge, defense and prosecution in the case about erskine's safety today.

I've reached out the attorney's about the meeting but haven't heard back tonight.

Hasaan erskine and burt were both in jail charged with capital murder.

The brothers are accused of murdering - charity fennell - in 20-18 at a home in north huntsville.

They have been in the jail since their arrests.

The judge for the case responded to erskine's attorney's motion and asked for the state to respond on or before next tuesday.

As of tonight - no response has appeared in the online court system
