Berkowitz, the lawyer for Lori Loughlin and her husband, Mossimo Giannulli, filed a motion after discovering evidence that allegedly proves his client's innocence.

According to ABC News, notes from the iPhone of Rick Singer, the ring leader in the University of Southern California (USC) college admission scandal, prove that the donations made by the couple were donations and not bribes.

Singer, who plead guilty to racketeering and fraud, reportedly told his lawyer that the FBI wanted him to "to tell a fib." Rick Singer, via ABC News Berkowitz asked to postpone the setting of a trial date until evidence disputes can be resolved.

Berkowitz, via ABC News Loughlin and Giannulli were charged with conspiracy to commit mail fraud, honest services mail fraud and conspiracy to commit money laundering.

They are accused of paying Singer $500,000 in bribes so their daughters could be recruited to USC's crew team, despite never having participated in the sport.
